The High Court of Justice has ordered Airbnb to immediately remove 5,800 tourist accommodation listings from its platform for violating regulations governing advertising for tourist accommodations. This ruling by the High Court of Justice dismisses Airbnb's appeal against the Ministry of Social Rights, Consumption, and the 2030 Agenda's order to block 65,935 tourist accommodation listings from the platform. Specifically, this first batch of 5,800 listings is the first of three resolutions the Ministry has sent to Airbnb in recent months after detecting irregularities. As indicated in the statement issued by the Ministry of Social Rights, Consumption, and the 2030 Agenda, the nearly 6,000 listings on which the High Court ruled correspond to tourist accommodations located in the regions of Andalusia, the Community of Madrid, Catalonia, the Community of Valencia, the Balearic Islands, and the Basque Country. This advertisement "violates the regulations of the different autonomous communities where the Consumer Affairs Department has detected these listings." What violations do the listings published on Airbnb present? The Directorate General for Consumer Affairs based its resolutions on three main violations detected in 65,935 tourist accommodation listings published on Airbnb. These are the following: The listings do not display the license or registration number: a mandatory requirement in several autonomous community regulations. This has been the most frequently detected violation. The license number indicated does not correspond to the one issued by the authorities: a practice that can mislead or deceive those who contract the service. The legal status of the landlords is not specified: it is not indicated whether they are professionals or individuals, which is essential information for the person renting the property to know whether or not they are protected as a consumer.
